  3. Intellectual Property
    1. The intellectual property in the materials in GeoPhoto and on our website are owned by or licensed to Timo Partl Software-Entwicklung.
    2. This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or these Terms of Use, and may be terminated by Timo Partl Software-Entwicklung at any time.

  4. User-Generated Content
    1. You retain your intellectual property ownership rights over content you submit to us for publication within GeoPhoto and/or on its corresponding website. We will never claim ownership of your content, but we do require a license from you in order to use it.

When you use GeoPhoto or its associated services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

  7. Liability
    1. We shall be liable for intent and gross negligence as well as for damages resulting from injury to life, body or health. Subject to the limitation in clause 5.4., we shall only be liable for slight negligence in the event of a breach of a cardinal obligation. Contractual cardinal obligations are obligations which protect the legal positions of the customer which are essential to the contract and which the contract must grant to the customer according to its content and purpose, or the fulfilment of which makes the proper execution of the contract possible in the first place and on the fulfilment of which the customer may rely.
    2. We owe the due diligence customary in the industry. In determining whether we are at fault, it must be taken into account that software cannot be created technically free of errors.
    3. In the event of slight negligence, liability shall be limited to the amount of the foreseeable damage, the occurrence of which must typically be expected, subject to the limitation in clause 5.4. However, this liability is limited to a maximum of the 10 times the licence fee from the contractual relationship.
    4. Liability for the loss of recorded data is excluded to the extent that it exceeds the damage that would have arisen if you as the customer had properly backed up the data in accordance with professional standards in terms of time frequency and backup procedures.
    5. Our liability during the period of use of the demo licence is limited to fraudulent concealment of defects and to intentional and grossly negligent acts. Our liability is excluded in the event of a slightly negligent breach of duty or tortious act.
    6. Insofar as our liability is excluded or limited in accordance with the above, this shall also apply to the liability of the legal representative bodies and vicarious agents, in particular our employees.
    7. As a customer, you are obliged to notify us immediately of any damage incurred by you, at least by e-mail, or to have it recorded by us, so that we are informed as early as possible and may be able to mitigate the damage together with you as the aggrieved customer.

  8. Haftung

    6. You agree to comply with any applicable third-party terms when using GeoPhoto, including any Usage Rules set forth in the Apple App Store Agreement of Service.
    7. 14. Severance
